Can an Out-of-State Subpoena be Served on Facebook?

In an increasingly interconnected digital age, many aspects of our daily lives have shifted online, including our social interactions. So it’s no surprise that, here at Accurate Serve® of Atlanta, we occasionally get the question – Can an out-of-state subpoena be served on Facebook? – and it’s a little hard to answer.

Let’s Look at the Laws

To address this, we must first understand the guidelines provided by Georgia’s Rules of Civil Procedure. While the rules extensively detail the methods and manners of serving processes, they do not explicitly mention the use of social media platforms like Facebook for this purpose. This lack of specific guidance might lead one to believe that serving subpoenas on social media is not permissible. However, the state of Georgia added a provision that offers some flexibility.

Specifically, Title 9, 9-11-4, Process, J. Alternative Service, states: “In all cases or special proceedings where the requirements or procedure for service, or both, are not prescribed by law and in any situation where the provisions therefor are not clear or certain, the court may prescribe service according to the exigencies of each case, consistent with the Constitution.” This clause essentially means that in cases where the method of service is not clearly defined or is ambiguous, the court holds the discretion to determine an appropriate method of service, as long as it is in line with the Constitution.

It’s a Maybe

Given this provision, it is conceivable that, under certain circumstances, a court might find it appropriate to allow service of a subpoena via a platform like Facebook, especially if traditional methods of service have proven ineffective and if the individual in question is actively using the platform and can reasonably be expected to receive the notice.

Approach With Caution

However, it’s essential to approach such unconventional methods with caution. The primary goal of any service is to ensure that the party in question is adequately informed. Using Facebook or any other social media platform should be backed by compelling reasons and should ideally be a method of last resort.
